1. Privacy Policy (PIPEDA Compliant)
Naina's Indian Kitchen (referred to as "we", "us", or "our") values your trust and is committed to protecting your personal information. This Privacy Policy outlines our practices regarding the collection, use, disclosure, and safeguarding of personal data in strict compliance with the Canadian federal Personal Information Protection and Electronic Documents Act (PIPEDA).
A. Information Collection
We collect only the personal information necessary to deliver our services, including:
- Identity & Contact Data: Your name, email address, and WhatsApp-enabled telephone number supplied during checkout.
- Geographical Location: GPS coordinates (only when explicit browser location permissions are granted) to identify and route orders to the closest kitchen branch (St. Marys or Listowel).
- Transaction Records: History of dishes purchased, transaction totals, and payment methods. We do not collect or store credit card credentials directly. Online transactions are routed and processed securely through Clover Sandbox Payment Gateway tokens.
B. Purposes of Collection and Processing
Your personal data is used solely to:
- Prepare and fulfill custom online orders at the correct kitchen location.
- Initiate automated WhatsApp alerts regarding order status (placed, cooking, ready for pickup).
- Issue official transactional purchase receipts to your email address.
- Improve system performance and address support queries via our AI Chatbot assistant.
C. Consent and Access Rights
By utilizing our ordering platform, you consent to the collection and processing of information outlined above. In accordance with PIPEDA, you hold the right to request access to any personal information we retain, request correction of inaccuracies, or request complete deletion of your customer records by contacting our Privacy Officer.
3. Terms of Service & Online Ordering
By accessing our website and placing food orders, you agree to comply with and be bound by the following terms and conditions. These terms constitute a legally binding agreement governing your operational interaction with Naina's Indian Kitchen.
A. Age Restrictions & Legality
Certain menu selections (e.g. licensed beverages offered at specific locations) require the customer to be of legal drinking age in the Province of Ontario (19 years of age or older). We reserve the right to request valid government-issued photo identification prior to handing over alcoholic menu items at pickup.
B. Accuracy of Menu Details
We make every effort to display accurate dish titles, descriptions, prices, spice indicators, and allergen tags. However, ingredient availability is subject to seasonal supply chains. Naina's Indian Kitchen reserves the right to decline or modify orders featuring pricing discrepancies or out-of-stock items.
4. Refund & Cancellation Policy (Ontario CPA)
Online transactions and agreements are protected under the Ontario Consumer Protection Act (CPA). In compliance with provincial mandates, our refund policies are outlined transparently:
If you are unsatisfied with the quality of your dishes or if an incorrect item was packaged, please notify the respective branch manager immediately upon pickup. Valid complaints will be resolved through item replacement, store credit vouchers, or full transactional reversals to the original payment card.
5. Anti-Spam (CASL) & Communications
We maintain a strict anti-spam policy governed by Canada's Anti-Spam Legislation (CASL). We do not transmit unsolicited commercial electronic messages (CEMs).
- Transactional Alerts: Message confirmations triggered via email (order receipts) or WhatsApp (order pickup updates) are strictly transactional. They are sent under implied consent to complete a retail transaction and do not feature promotional marketing content.
- Promotional Material: Marketing newsletters and coupon promo code updates are only delivered to users who have explicitly opted-in. You retain the right to withdraw consent and opt-out at any time via the unsubscribe links featured at the foot of our marketing communications.
